Important Definitions

Privacy Policy: A legal document that explains how a portal or organization collects, uses, stores, shares and protects users’ personal information.

Terms and Conditions of Use: A legal agreement between the portal and its users. It outlines the rules, responsibilities and limitations that users must agree to in order to use the portal or its services.

Samaritan Health Plans Member Portal Privacy Policy


Samaritan Health Plans (“SHP,” “we,” “our,” or “us”) is committed to protecting the privacy and security of your personal information. This Privacy Policy explains how we collect, use, disclose, protect, retain, and otherwise process personal information when you access or use the Samaritan Health Plans Member Portal, mobile application, and related online services (collectively, called the “Platform”).

SHP uses authorized technology service providers to develop, host, maintain, secure, and support the Platform on our behalf. These providers are contractually required to protect the information they process and may use it only as necessary to provide services for SHP. This Privacy Policy applies only to information collected through or in connection with your use of the Platform.

Certain information available through the Platform, including Protected Health Information (“PHI”), is protected by the Health Insurance Portability and Accountability Act (“HIPAA”) and other applicable federal and state laws.

The Samaritan Health Plans Notice of Privacy Practices explains how SHP may use and disclose PHI, your privacy rights, and SHP’s legal obligations under HIPAA. This Privacy Policy complements the Samaritan Health Plans Notice of Privacy Practices by describing how personal information is handled when you use the Platform, including information associated with your account and your interaction with the Platform.
 
Where information is subject to HIPAA, SHP will use and disclose that information in accordance with the Samaritan Health Plans Notice of Privacy Practices and applicable law.

SHP collects only the information necessary to provide member services, secure the Platform, administer health plan benefits, and comply with legal and regulatory requirements. Depending on features used within the Platform, SHP may collect the following categories of information:

  • Personal identifiers (e.g., name, member ID, username, email address, phone number)
  • Health and health insurance information
  • Authentication credentials and security information
  • Device information (e.g., device type, operating system, browser version)
  • Platform activity and usage information
  • Network and connection information, including IP address
  • Communication preferences
  • Communications sent through the Platform
  • Information submitted through forms or secure messages
  • Other information you choose to provide through available Platform features

The Platform also provides secure access to information maintained by SHP in connection with your health plan membership and services, including eligibility, benefits, claims, digital member identification cards, secure messages, care management information, and other information made available through the Platform.
 
When you use the Platform, certain technical information is collected automatically to support authentication, Platform functionality, security, troubleshooting, and system performance. This information may include your Internet Protocol (IP) address, browser type, mobile device type, operating system, date and time of access, session information, authentication logs, and other technical information necessary to operate and support the Platform.

We use information to provide member portal services, authenticate users, administer accounts, deliver benefit and claims information, provide member communications, improve portal functionality, troubleshoot issues, prevent fraud and misuse, comply with legal obligations, and protect the confidentiality, integrity, and availability of member information.

The Platform supports electronic communications between you and SHP regarding your health plan membership and the services available through the Platform.

Information communicated through the Platform may include account notifications, secure messages, benefit or claims information, responses to your inquiries, and other information related to the administration of your health plan.

Where available, you may manage certain communication preferences through the Platform or by contacting SHP. However, SHP may continue to send communications necessary to administer your health plan, maintain your account, protect the security of the Platform, or comply with applicable legal, regulatory, or contractual requirements. Electronic communications made available through the Platform are intended to supplement, and not replace, other communications or notices that SHP may provide as required by applicable law or your health plan.

The Platform is hosted and operated with support from third-party service providers acting on behalf of SHP. These service providers may process information as necessary to provide hosting, security, authentication, technical support, analytics, member engagement, and related operational services. Such providers are contractually required to safeguard information in accordance with applicable legal and contractual requirements.

SHP and its service providers maintain administrative, technical, and physical safeguards designed to protect information from unauthorized access, use, disclosure, alteration, or destruction. Security controls may include user authentication, multi-factor authentication, encryption, audit logging, access controls, monitoring, and incident response processes. Information transmitted between your device and the Platform is protected using industry-standard encryption technologies designed to safeguard information during transmission.

The Platform may use cookies, session identifiers, device identifiers, log files, and similar technical identifiers necessary for authentication, fraud prevention, security monitoring, session management, and application functionality. Information collected may include IP address, browser type, operating system, device identifiers, access times, and usage patterns. The Platform does not use cookies or similar technologies for targeted advertising or cross-site behavioral advertising.

  • Health information is collected to provide member services.
  • Personal information is collected to authenticate users and administer accounts.
  • Device and technical information is collected to secure and operate the Platform.
  • Information is shared only with authorized service providers and parties permitted or required by law.
  • Information is not sold.
  • Information is not used for targeted advertising.
  • Information is encrypted in transit.
  • Users may contact SHP regarding privacy rights and account management.

If you access the Platform through a mobile application, SHP and its authorized service providers may collect, use, and disclose information as described in this Privacy Policy and as necessary to provide, secure, maintain, and improve mobile application functionality.

The categories of information that may be collected through the mobile application include:

  • Personal identifiers, such as your name, member identification number, username, email address, telephone number and account information
  • Information related to your health plan membership and services, including information made available through the Platform regarding eligibility, benefits, claims, care management, secure communications and other health plan functions
  • Technical and device information, including device type, operating system, browser type, application version, device identifiers, Internet Protocol (IP) address, authentication records, network information and diagnostic information
  • Information regarding your use of the Platform, including access times, session information, feature utilization, security events and application performance data

Information collected through the mobile application is used to authenticate users, provide requested services, administer accounts, display member information, support customer service activities, maintain security, detect and prevent fraud or misuse, troubleshoot technical issues, improve application performance, comply with legal and regulatory requirements, and protect the confidentiality, integrity, and availability of information.

The Platform does not use information collected through the mobile application for targeted advertising, cross-site behavioral advertising, or the sale of personal information.

Unless specifically disclosed within a particular feature, the Platform does not collect precise geolocation information from your mobile device. Network-related information, including IP addresses, may be used for security, fraud prevention, authentication, and operational purposes.

Information transmitted between your device and the Platform is protected through encryption and other security safeguards designed to protect information during transmission and storage.

Authorized technology service providers acting on behalf of SHP may process information as necessary to provide hosting, authentication, security, analytics, technical support, communications, and other operational services associated with the Platform. These service providers are contractually required to safeguard information and may use such information only for authorized purposes.

Members who wish to close their Platform account or have questions regarding the information associated with their use of the Platform may contact SHP using the contact information provided below. Certain information may be retained following account closure as required by applicable law, HIPAA, contractual obligations, records-retention requirements, fraud prevention needs, or other legitimate business and regulatory purposes.

SHP may disclose personal information associated with your use of the Platform only as permitted or required by applicable law and as necessary to administer your health plan, operate the Platform, or provide requested services.

We may disclose information to authorized technology service providers and other contractors that perform services on SHP’s behalf, including supporting the development, hosting, maintenance, security, and operation of the Platform;  healthcare providers, health plans, or other organizations, as permitted or required to administer your health plan benefits or related services;  government agencies, regulators, auditors, accrediting organizations, or law enforcement when authorized or required by applicable law; or with your authorization or at your direction, when required by applicable law.
 
SHP does not sell your personal information or PHI and does not disclose personal information collected through the Platform for targeted advertising or cross-site behavioral advertising.

Information is retained according to applicable legal, regulatory, operational, contractual, and records-retention requirements. Retention periods may vary depending on the type of information and applicable obligations. Members may request closure of their Platform account by contacting SHP. Certain information may be retained following account closure as required by law, HIPAA, contractual obligations, fraud prevention requirements, litigation holds, or applicable records retention requirements.

Depending on applicable law and the type of information involved, you may have certain rights regarding your personal information and PHI.

For information subject to HIPAA, your rights are described in the Samaritan Health Plans Notice of Privacy Practices and may include the right to:

  • Access your PHI
  • Request an amendment to your PHI
  • Request confidential communications, where applicable
  • Request an accounting of certain disclosures
  • File a privacy complaint without fear of retaliation

The Platform is intended for SHP members and other authorized users.

Access to information relating to minors, dependents, and other individuals represented through the Platform is governed by applicable federal and state law, the Samaritan Health Plans Notice of Privacy Practices, and SHP policies regarding parents, guardians and other authorized personal representatives.

The Platform may contain links to websites or services that are not owned or controlled by SHP. This Privacy Policy applies only to the Platform and does not apply to third-party websites or services. SHP is not responsible for the privacy, security, or content of third-party websites or services. Users should review the privacy policies of those third parties before providing personal information.

SHP may update this Privacy Policy from time to time to reflect changes in applicable law, technology, Platform functionality or business practices.
 
When required by applicable law, SHP will provide notice of material changes through the Platform, the SHP website, or other appropriate communication methods. The revised Privacy Policy becomes effective on the effective date identified in the updated version.

Member Portal Terms and Conditions of Use

By creating an account, registering for, accessing, or using the Samaritan Health Plans (“SHP”) Member Portal (“Portal”), you acknowledge that you have read, understand, and agree to be legally bound by these Terms and Conditions of Use (“Terms”).
 
Your use of the Portal is also subject to the SHP Member Portal Privacy Policy and any other policies or guidelines incorporated by reference. If you do not agree to these Terms, you must not register for, access, or use the Portal.

The Portal is provided by SHP to offer eligible members secure electronic access to health plan information and authorized self-service features, including eligibility, benefits, claims, digital member identification cards, communications, and other services made available through the Portal. SHP utilizes authorized technology service providers to develop, host, maintain, and support the Portal on SHP’s behalf. The Portal is intended to supplement, but not replace, official plan documents, legally required notices, Member Services, or communications with healthcare providers.

Portal access is limited to eligible SHP members and other individuals authorized by SHP.
Users must provide accurate and complete registration information, maintain current account information, and promptly update information as necessary. SHP reserves the right to verify a user’s identity before granting, restoring, or modifying their Portal access.

The Portal incorporates administrative, technical, and physical safeguards designed to protect information. Security features, including user authentication, account protection, and other technical controls, may be implemented by SHP and its authorized service providers.
 
Users are responsible for maintaining the confidentiality of their usernames, passwords, authentication credentials, and devices used to access the Portal. Users must promptly notify SHP of any suspected unauthorized access, credential compromise, or other security concerns involving their account.

SHP and its service providers will make reasonable efforts to maintain Portal availability but do not guarantee uninterrupted access. Maintenance, technical issues, security events, and third‑party dependencies may affect service availability.

Users agree to use the Portal only for lawful purposes, maintain accurate account information, protect credentials, avoid sharing access, and comply with applicable laws, regulations, and plan requirements.

Users may not attempt to bypass security controls, gain unauthorized access, interfere with Portal operations, introduce malicious code, scrape content, perform denial-of-service activities, or use the Portal for unlawful, fraudulent, harassing, or abusive activities.

The Portal may provide access to protected health information (PHI), benefit information, claim information, and account communications. Users are responsible for protecting information accessed through their accounts.

The Portal is not intended for medical emergencies. Members should contact emergency services or appropriate healthcare resources when immediate assistance is required.

The Portal is operated with support from third-party service providers. Certain technical functions, hosting, authentication, communications, and support services may be performed by service providers acting on behalf of SHP.

The collection, use, disclosure, storage, and protection of personal information and PHI through the Portal are governed by the Member Portal Privacy Policy, the Samaritan Health Plans  Notice of Privacy Practices, where applicable, and applicable federal and state laws.

Portal content, branding, software, text, graphics, and related materials remain the property of SHP, its affiliates, licensors, or service providers unless otherwise stated.

SHP may suspend, restrict, or terminate Portal access when reasonably necessary to:

  • protect the security or integrity of the Portal
  • protect the privacy or security of member PHI
  • investigate suspected fraud, unauthorized access, or misuse
  • comply with legal or regulatory requirements
  • enforce these Terms

To the fullest extent permitted by law, the Portal is provided on an “as is” and “as available” basis. SHP disclaims all warranties, whether express or implied, regarding the availability, reliability, accuracy, or uninterrupted operation of the Portal.

To the fullest extent permitted by law, SHP shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from Portal use.

SHP may modify the Portal, these Terms, or related policies from time to time. Material changes will be communicated as required by applicable law. Continued use of the Portal after the effective date of revised Terms constitutes acceptance of those revisions.

These Terms shall be governed by applicable federal law and the laws of the State of Oregon, without regard to conflict-of-law principles.
